City Pacific Limited (City Pacific or Company) commenced legal proceedings in the Federal Court of Australia against Balmain Trilogy & Others. Today the Honourable Justice Dowsett of the Federal Court of Australia, has handed down his judgement in favour of Balmain Trilogy & Others. The decision of the Federal Court means that the resolution, which was put to the Unitholders at the meeting held on 25 June 2009 is effective to remove City Pacific as responsible entity of the City Pacific First Mortgage Fund (Fund). The Board of City Pacific advises that they will consult with their advisors in respect to the decision of the Federal Court and provide an update to the market in due course
